New York Therapist Billing: Superbills and OON Reimbursement Guide

New York has some of the highest therapist fees in the country and strong insurance parity protections. Here is what NY-licensed therapists need to know about out-of-network billing, superbills, and the state's major payers.

New York License Types: LCSW vs LCSW-R

New York has two tiers of Licensed Clinical Social Worker licensure, and the difference matters for billing:

  • LCSW โ€” Licensed Clinical Social Worker. Can diagnose and treat mental health conditions, issue superbills, and bill insurance independently.
  • LCSW-R โ€” LCSW with the "R" designation indicating registration for independent private practice with the New York State Education Department. The LCSW-R is required to practice privately without supervision. Most insurers require the LCSW-R (not just LCSW) for credentialing and superbill reimbursement.

If you hold only an LCSW in New York and are practicing under supervision, confirm with each payer whether they will accept superbills from non-R LCSWs before promising reimbursement to clients.

New York Mental Health Parity Law

New York's Mental Health and Substance Use Disorder Parity Law (Insurance Law ยง3221(l)(5) and ยง4303(g)) is stronger than federal MHPAEA. Key provisions:

  • Insurers must cover mental health and substance use disorder treatment at the same level as comparable medical/surgical benefits
  • Separate deductibles, out-of-pocket maximums, or session limits for mental health are prohibited
  • The New York State Department of Financial Services (DFS) actively enforces parity violations and has fined major insurers

NYC OON Fee Ranges

  • Manhattan: $250โ€“$350 per 50-minute session
  • Brooklyn / Queens: $200โ€“$280 per 50-minute session
  • Westchester / Nassau / Suffolk: $180โ€“$250 per 50-minute session
  • Upstate NY (Albany, Buffalo, Rochester): $130โ€“$190 per 50-minute session

Major New York Payers

  • Empire BlueCross BlueShield โ€” Largest commercial payer in NY; strong PPO OON benefits; clients submit via empireblue.com
  • UnitedHealthcare (Oxford) โ€” Oxford plans are UHC NY products; standard OON superbill submission via myuhc.com
  • Aetna NY โ€” PPO plans accept superbills; 4โ€“6 week processing time
  • Oscar Health โ€” NY-founded insurer; PPO plans have OON benefits; submit via Oscar app or portal
  • Cigna โ€” Available on NY ACA marketplace and employer plans; standard OON process

NY Essential Plan and OON Therapy

The NY Essential Plan is a low-cost health insurance option for income-eligible New Yorkers. Essential Plan is an HMO-style product with no out-of-network benefits for non-emergency care. Clients on the Essential Plan cannot submit superbills for OON therapy reimbursement. Recommend sliding scale or in-network referrals for these clients.

Telehealth Billing in New York

New York enacted strong telehealth parity in 2020 and expanded it in 2022. Commercial insurers must reimburse covered telehealth services at the same rate as in-person care. Use POS 10 for client-in-home telehealth. The GT or 95 modifier may be required by specific payers โ€” check each plan's billing guidelines.

Filing Insurance Complaints in New York

Clients whose OON claims are wrongly denied or underpaid can file complaints with the New York State Department of Financial Services at dfs.ny.gov or call 1-800-342-3736. DFS has broad authority to investigate and penalize parity violations.
