Massachusetts is nationally recognized for its mental health parity protections and near-universal insurance coverage. For therapists practicing OON in Boston, Cambridge, or anywhere in the Commonwealth, understanding the Blue Cross MA-dominated insurance landscape and Massachusetts' uniquely strong parity laws is essential.

Overview

Massachusetts has some of the strongest consumer protections for mental health coverage in the country. Combined with a large, well-insured population and high demand for therapy services, the Commonwealth is an excellent environment for out-of-network practice. Proper superbills are the key tool connecting OON therapists with their clients' insurance benefits.

Massachusetts Licensing

The Massachusetts Board of Registration of Social Workers, Board of Registration of Allied Mental Health and Human Services Professions, and Board of Registration of Psychologists regulate mental health licensure in Massachusetts. License types for OON billing:

  • LICSW — Licensed Independent Clinical Social Worker (the highest independent practice level for social workers in MA)
  • LCSW — Licensed Certified Social Worker (supervised level in MA; limited independent billing)
  • LMHC — Licensed Mental Health Counselor
  • LMFT — Licensed Marriage and Family Therapist
  • Licensed Psychologist — Doctoral level

Note that in Massachusetts, the independent billing-eligible social work license is the LICSW, not the LCSW. An LCSW in Massachusetts is a supervised-level license. Make sure your license type is accurate on your NPI registration and taxonomy code when completing superbills.

Massachusetts Insurance Landscape

Blue Cross Blue Shield of Massachusetts dominates the commercial insurance market and is particularly important for OON therapists:

  • Blue Cross Blue Shield of Massachusetts — The largest insurer in the state, covering a substantial majority of employer-sponsored plans in Massachusetts. PPO and preferred provider plans include OON mental health benefits. Clients submit superbills via bluecrossma.org or by mail. Blue Cross MA typically processes OON mental health claims within 30–45 days.
  • Tufts Health Plan — Second largest commercial payer in MA. PPO plans have OON mental health benefits. Clients submit through the Tufts member portal.
  • Harvard Pilgrim Health Care — Merged with Tufts Health Plan under Point32Health. OON benefits available on PPO plans; HMO plans have no OON benefit.
  • Aetna — Present primarily in employer-sponsored plans. Standard OON PPO benefits apply.
  • UnitedHealthcare — Smaller market share in MA than nationally but present in large employer plans. OON claims via myuhc.com.
  • MassHealth (Massachusetts Medicaid) — Does not provide OON psychotherapy benefits for standard MassHealth members. MassHealth clients cannot submit superbills.

Massachusetts Parity Protections

Massachusetts has historically led the nation in mental health parity protections. The Massachusetts Mental Health Parity Law (M.G.L. c. 176A, § 8A; c. 176B, § 4J; and related statutes) requires that mental health and substance use disorder benefits be provided at parity with medical and surgical benefits. Key points:

  • MA parity law applies to fully insured commercial plans regulated by the state — this covers most plans offered by Massachusetts-based employers
  • Self-funded employer plans are governed by federal MHPAEA, not state law, but federal parity still provides substantial protections
  • MA parity law requires coverage for a defined list of mental health diagnoses with no session limits — among the most expansive such requirements nationally

If a client believes their plan is violating parity, they can file a complaint with the Massachusetts Division of Insurance or use the MA Health Insurance Consumer Assistance Program (HICAP).

Telehealth Rules

Massachusetts enacted telehealth parity requirements (Chapter 260 of the Acts of 2020 and subsequent legislation) requiring commercial insurers to cover telehealth mental health services at parity with in-person care through at least 2025. For OON superbills:

  • Use Place of Service 10 for telehealth sessions when the client is at home
  • Massachusetts was an early adopter of audio-only telehealth parity; many MA plans cover audio-only sessions — confirm with each plan's member services

Estimated OON reimbursement for CPT 90837 in Massachusetts:

  • Boston / Cambridge / Brookline: Private pay $200–$320; OON reimburse ~$90–$150
  • Newton / Wellesley / Suburban Boston: Private pay $190–$300; OON reimburse ~$85–$145
  • Worcester / Springfield: Private pay $140–$210; OON reimburse ~$65–$105
  • Cape Cod / Western MA: Private pay $130–$190; OON reimburse ~$60–$100

Tips for Massachusetts Therapists

  • Know the LICSW vs LCSW distinction. Massachusetts insurers distinguish between LICSW (independent) and LCSW (supervised). Billing with the wrong credential on a superbill can lead to claim denials.
  • Confirm plan type with Blue Cross MA clients. Blue Cross MA offers both HMO and PPO products. HMO plan members typically have no OON benefit; PPO plan members do. Always confirm the plan type before assuming a client can submit superbills.
  • Leverage strong parity protections. Massachusetts's parity laws are among the most consumer-friendly in the country. Educate your clients about their parity rights so they can advocate for themselves when insurers apply improper limitations.
